I. General Provisions
1.1 Scope and Application
The Terms and Conditions (hereinafter referred to as "Terms" or "Rules") serve as a legally binding document establishing the rights, obligations, and responsibilities between you, the Buyer, and us, Star Stone (referred to as "the Seller").
1.2 Amendments
The Seller reserves the right to modify, amend, or update these Terms at any time. Changes will be updated on our website, and it is your responsibility to review these Terms regularly.
II. Contract Formation
2.1 Agreement Binding
A binding contract between the Buyer and the Seller comes into effect when the Buyer places an order and confirms acceptance of these Terms.
III. Seller’s Rights and Obligations
3.1 Operational Discretion
The Seller may temporarily or permanently suspend the operation of the online store in significant circumstances, without prior notification to the Buyer.
3.2 Security Measures
If the Buyer attempts to undermine the security or operation of the online store, the Seller reserves the right to restrict or terminate the Buyer's access without warning.
3.3 Service Provision
The Seller commits to allowing the functionalities of the online store, as defined by these Terms.
3.4 Order Fulfillment
The Seller agrees to deliver the goods purchased based on the delivery method chosen by the Buyer, in alignment with these Terms.
3.5 Unforeseen Circumstances
Should unforeseen circumstances prevent the Seller from delivering the ordered items, the Seller will notify the Buyer and may propose a similar product. If the Buyer refuses, the Seller will refund the payment within three (3) business days.
3.6 Refunds
Upon the Buyer's valid cancellation of an order, the Seller agrees to refund the payment within five (5) working days from the day of receipt of the returned goods.
3.7 Conditions for Refund
The Seller will not refund the Buyer until the goods are returned or the Buyer provides evidence of having sent back the goods, whichever comes first.
IV. Buyer’s Rights and Obligations
4.1 Right to Purchase
The Buyer has the right to purchase goods according to these Terms.
4.2 Right to Cancel
The Buyer may cancel an order by notifying the Seller in writing within 14 calendar days from the day of delivery, provided the goods are in their original condition and have not been used.
4.3 Limitation on Right to Cancel
The right to cancel cannot be exercised if the product has been damaged or its appearance substantially altered.
4.4 Payment and Acceptance
The Buyer must pay for the purchased goods and accept them as per these Terms.
4.5 Unjustified Refusal
If the Buyer refuses to accept delivery without valid reasons, the Buyer shall bear the costs for the return of the items.
4.6 Inspection Upon Delivery
During the delivery, the Buyer should inspect the goods and their condition in collaboration with the Seller or the delivery person.
4.7 Compliance
By using Star Stone, the Buyer confirms acceptance of these Terms and commits to abide by them.
V. Pricing, Ordering, and Payments
5.1 Currency and Taxes
Prices are in euros and include VAT. Delivery fees are added during order confirmation.
5.2 Ordering Procedure
The Buyer shall provide necessary personal data for order fulfillment: name, address, phone number, and additional delivery information. Confirmation of the order implies the Buyer’s acceptance of these Terms.
5.3 Payment Methods
To ensure convenience and security for our customers, the following online payment platforms are supported:
Stripe: A trusted online payment provider, Stripe offers a default bank card payment option. Additional payment methods such as Apple Pay, Google Wallet, and Klarna are also available, depending on the store's country and currency.
kevin.: Specializing in secure and user-friendly payments infrastructure, kevin. facilitates direct payments from banks across 27 EU and EEA countries.
PayPal: A widely recognized and secure online payment gateway, PayPal is available for all transactions on our store.
All payments are processed securely and are subject to the terms and conditions specified in the store's rules and regulations.
VI. Shipping and Delivery
6.1 Address Specification
The Buyer must specify an accurate delivery address.
6.2 Acceptance Responsibility
If the Buyer cannot personally accept the delivery, the Buyer bears the risk of the items being received by an unauthorized person at the specified address.
6.3 Delivery Timeline
Due to the handcrafted nature of our eco-resin art pieces, please allow a period of 2-5 business days for your order to be fulfilled. This time is reserved to ensure that each product meets both our high-quality standards and your expectations. While orders are often ready before this timeframe, we allocate these additional days as a precautionary measure. Should you require your order to be expedited, please contact us directly. We are committed to finding a solution that meets your needs.
6.4 Product Description
The Seller is not responsible for any discrepancies in color, shape, or other parameters due to the Buyer's monitor characteristics.
6.5 Cancellation Refunds
If an order is canceled, as per Seller's mistake, all amounts, including delivery costs, will be refunded to the Buyer. More information is in Refunds and Returns Policy.
VII. Returns and Refunds
7.1 Return Policy
Quality goods can be returned within 14 days of receipt, as defined by the Civil Code of the Republic of Lithuania.
7.2 Conditions for Return
The conditions for return include the item being in its original packaging, undamaged, unused, and with its commercial appearance intact.
7.3 Return Procedure
Returns are processed within 14 days from receipt, unless the goods are defective, in which case statutory warranty periods apply.
7.4 Refund Timing
Refunds will be processed no later than five (5) working days after receipt of returned goods, unless otherwise agreed between the Seller and the Buyer.
VIII. Final Provisions
8.1 Governing Law
These Terms are constructed in accordance with the laws of the Republic of Lithuania.
8.2 Dispute Resolution
Disputes shall be resolved through negotiation; failing that, legal channels will be pursued as per the laws of the Republic of Lithuania.
8.3 Force Majeure
Neither party is liable for failure to fulfill obligations due to unforeseen circumstances beyond their control.
